Terms of service

These terms govern your use of QuestOmics. By creating an account or using the platform, you agree to them. Please read them alongside our Privacy Policy.

The service

QuestOmics is a microbiome analysis platform. You upload sequencing data, select biological questions, and receive interpretable, reproducible results and reports. The available analyses, limits, and plans are described on the platform and may evolve over time.

Provider and legal information

QuestOmics is operated by Sandro Valenzuela as a sole proprietorship (eenmanszaak) established under the laws of the Netherlands. The business is registered with the Dutch Chamber of Commerce. (KvK number, VAT/BTW number, and registered address: I am working on it, I promise I will place the ID or address asap!) The business is established and taxed in the Netherlands, and value added tax (VAT/BTW) is accounted for under Dutch and EU rules. Prices and the applicable VAT are shown at checkout. For valid VAT-registered business customers in other EU countries, the EU reverse-charge mechanism may apply.

Your account

You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for activity that occurs under your account. Notify us promptly if you believe your account has been compromised.

Acceptable use

You may only upload data that you have the right to use. You agree not to use the platform for unlawful purposes, not to attempt to disrupt or reverse-engineer the service, and not to interfere with other users or with platform infrastructure.

Your data and content

You retain ownership of the data you upload and the results generated from it. You grant QuestOmics only the limited permission needed to process that data to provide the service. We do not use your data for external research; see our Privacy Policy for the full statement.

Plans, credits, and billing

Paid plans and analysis credits (ATP) are offered as described on the pricing page. Charges apply according to the plan or credits you select, and specific entitlements and limits are shown in your workspace. If an analysis fails, the ATP spent on that run is automatically returned to your balance. If you delete an analysis run or a project, the ATP spent on it is likewise refunded. Monthly plan ATP carries forward and does not expire while your plan is active, and purchased top-up ATP does not expire. Where you are a consumer in the EU, your statutory rights, including any right of withdrawal that applies before a service is performed, are unaffected by these terms.

Limits of our responsibility

QuestOmics results are provided for research purposes and are not intended for clinical, diagnostic, or medical decision-making. Results depend on the data you provide, and the service is provided on an “as is” and “as available” basis, subject to maintenance and occasional downtime. We are not responsible for ensuring you hold the rights to the data you upload. To the extent permitted by Dutch and EU law, QuestOmics is not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid for the service in the preceding twelve months. Nothing in these terms excludes liability that cannot be excluded by law.

Governing law and disputes

These terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved informally will be submitted to the competent courts of the Netherlands. If you are a consumer, the mandatory consumer-protection rules of your country of residence still apply to you.
